Price of product in supermarkets must be highlighted

The supermarket chain Carrefour, in Goiás, is obliged to set the prices of its products on the shelves clearly and prominently. The decision was made by judge Jair Xavier Ferro, from the 10th Civil Court of Goiânia. The judge accepted, in part, a public civil action filed against the supermarket by the Public Prosecutor's Office. Prosecutors also asked for the supermarket to be condemned for moral damages, but the judge considered the measure inadmissible. Judge Xavier Ferro also established that if the amount charged at the checkout differs from that announced on the label, the lowest price must prevail, under penalty of a fine of R$1,000 per unit of product. The amounts collected as a result of fines must be allocated to the State Consumer Protection Fund and the Municipal Consumer Protection Fund in the proportion of 50% for each.
According to the MP, research carried out at Carrefour units in Goiânia found that of the 2,663 products checked, 960 were without price tags. A report carried out in July would have shown that 26 of 557 products had different prices on the shelf and at the checkout. In its defense, Carrefour detailed the mechanism of its sales system, claiming that suppliers are not obliged to set price tags per unit of product and that the value of the intended compensation was high. The supermarket chain maintained that the action brought by the MP had lost its purpose due to the recent Law 10,962/04.
Judge Xavier Ferro considered that the law did not result in the extinction of the action because it did not free companies from fixing prices on products, but only allowed them to choose how to print the value on the packaging: by using the reference code or using the code of bar. Also according to the judge, article 31 of Law 8,078/90 establishes that “the offer and presentation of products and services must ensure correct, clear, precise, conspicuous information in Portuguese about their characteristics, qualities, quantity, composition, price, guarantee, deadlines, validity and origin, among others, as well as the risks they pose to the health and safety of consumers”.Those affected do not discuss whether or not the protest by the IRS employees is legitimate.
